From Kathryn A. Wright, Chair, Grand Re-opening committee: The main area of the library has been painted. The service kiosk needs more work than originally thought, but that will be done. Work will continue on the roof as weather permits. New library signs are ordered.
The committee planning the Grand Re-Opening Celebration has declared the overall theme for the re-opening festivities is “Celebrating a Brighter Future for Mason Square” - based on the mission and vision of the Springfield City Library system. Probable date will be early March, when the renovations are completed to both the “library side” and the newly restored community room.
12/3/2010
From Molly Fogarty, Director, Springfield City Library: Jean Canosa, Carol Leaders and I met Scott Pierce at the Mason Square Branch this morning. The Sheriff's Office Painting crews completed painting the ceiling, walls and have cleaned the lights in the main area and the Children's Program room. They are doing an amazing job and will continue to paint until all of the rooms are completed. In addition, they have removed the shelves from the perimeter shelving units and are sanding and refinishing them. Work will soon begin on the new roof, Career Center, vestibule, as well as repairs to the service kiosk.
Kat Wright, Chair of the 2010 Committee to Plan the Grand Re-Opening of Mason Square Library, held the first meeting of the Committee on December 1. It was a very productive meeting and working groups are already established, with the goal of a major community wide celebration. This is a very exciting time for all of us.
11/19/2010
From Molly Fogarty, Director, Springfield City Library: This has certainly been a very exciting week for all of us. Since the Urban League has moved out, we have visited the library with Ed Pikula and Scott Pierce from City Facilities.
Interior painting has already begun, roof repair will begin the first week of December, and other interior repairs will begin in the very near future. As soon as these renovations are completed, the carpeting will be replaced.
John Ramsay was interviewed by WFCR and many individuals including Mo Jones and Ruth Loving were interviewed by Peter Goonan.
As work progresses we will update our website. www.springfieldlibrary.org/branches/ms (look at our website for new photos)
Kat Wright is chairing the Neighborhood steering committee to help us plan the Grand Opening event. Our first meeting will be held on Wednesday, December 1.

MSL Weekly Update
Friday, November 5, 2010
From Edward M. Pikula, Springfield Law Dept.: Our relocation expert, Steve Mollica has been working with the Urban League relocation specialist and the move is on target to be accomplished by Nov. 15. I personally met with Henry Thomas on Tuesday Nov. 2 and discussed the matter. He confirmed that their phones will be shut down and transferred to the STCC location for next weekend. We are still negotiating over payments for use and occupancy and relocation in the normal course of the statutory requirements, and I do not expect that those financial issues will be resolved prior to the move, but, based on the communications with Mr. Mollica and Mr. Thomas, I do not expect the City Council to vote on an eviction order.
From Molly Fogarty, Director, Springfield City Library: At this point, we are planning a tentative opening date for January 26, 2011. Once we move the books from the current space to the new space, renovations will begin for the new Community Room. Since that involves new lighting, painting, carpeting, wiring and installation of equipment, we are projecting that will take about three weeks. I have had discussions with Kat Wright, who is organizing the community steering committee to plan the grand opening event. Tentative Date for the Grand Opening: February 24, 2011. As soon as we have more details, we will keep everyone updated.

The Urban League is still scheduled to move out by November 15th.

MSL Weekly Update
Friday, October 8, 2010
From Molly Fogarty, Director, Springfield City Library: Thanks to all of the wonderful and passionate library supporters at last Monday's [Oct. 5 City] Council meeting. An article in yesterday's Springfield Republican by Peter Goonan summarized the Council meeting. The following key points were addressed:
• The City Council will consider voting for immediate eviction of the Urban League at its November 8th meeting if the Urban League is not prepared to vacate by the new deadline, November 15.
• [City] Attorney Ed Pikula stated that eviction can be pursued under state law, with the [City Council] having the power to vote to issue a warrant to the sheriff to evict the tenant "forthwith."
• This item will be on the November 8th City Council meeting, for discussion and vote, if necessary.
• The [City] Council voted to accept $196,923 from the Springfield Library Foundation and $74,839 from the Springfield Museums Association, to pay for phase one renovations, furniture, shelving and equipment.
In addition:
• Roof repair will begin early next week. The delay is due to several days of rain this week.
• The vendors will store the furniture and equipment to accommodate a mid [to] late January opening.
• We plan to work with the Mason Square Advisory Committee to plan a major celebration, once the Branch is open. We welcome your suggestions!!
The Law Department does not have any further updates for this week.

MSL Weekly Update
FRIDAY, OCTOBER 1, 2010
From Molly Fogarty, Director, Springfield City Library: Ed Pikula (City Law Dept) is not available today to send an update. I am sending you a summary of this week's activities related to Mason Square. If there are any further updates, I will forward those on Monday.
• The City Law Department has received correspondence from Craig Brown, Attorney for the Urban League. The letter states that the Urban League's delay in vacating the premises until November 15, 2010 is directly attributable to the unanticipated construction work that must be performed with respect to the leased space at STCC Technology Park in order to satisfy fire code requirements.
• This will delay the planned re-opening from November to January, which reflects the timeline provided by our Architect, Steve Jablonski. We have contacted the Vendor to let them know that we cannot accept delivery of the furniture and shelving, the week of November 8th as planned. There will certainly be financial considerations to consider, i.e. storage fees, which we will be investigating.
• A Use and Occupancy Agreement has been sent to the Urban League. (I will ask Ed Pikula to follow up on that issue on Monday.) It is my understanding that the Urban League has not paid any use and occupancy fees as of this date, but need confirmation from the Law Department.
• The City Council Veterans, Administration, and Human Services Committee discussed this updated information on September 29. Councilor Rooke attended the meeting. At the meeting Ed Pikula reported that an Eviction notice will not be issued to the Urban League at this time, but that the City Law Department reserves the right to revisit this, if there is any further delay.
• A financial order has been submitted to the City Council for the October 4th meeting, authorizing the Mayor to accept a Gift in the amount of $196.923.50 from the Springfield Library Foundation for the Mason Square Branch Library.
Please contact me if you have any questions.

MSL Weekly Update
Urban League still occupying our Library building
From Attorney Ed Pikula, Springfield City Law Dept: We have been working with Springfield Library Foundation (SLF) and Springfield Library and Museums Association (SLMA) to secure the monies to cover the costs of the renovations. We expect to go before the City Council on October 4, 2010 for an order to accept and appropriate funds for these initial phases of the renovations required to re-establish a full service library.
The City's relocation expert spoke with Mr. Thomas [CEO of the Springfield Urban League] on 9/23 and was told that documents have been signed to lease space at STCC. He also told [the relocation expert,] Mr. Mollica that he has been working on getting bids and scopes of work to complete their move. He told Mr. Mollica that the Urban League needs funds from the Urban League endowment committee to satisfy the requirement of the landlord that they have funds in place for the build-out work. He also told Mr. Mollica that [Springfield Urban League Attorney] Craig Brown is sending a letter with a summary of where they are at in the process.
[Mr. Thomas] also told Mr. Mollica that he now expects to vacate by the second or third week of October. He told Mr. Mollica that he would cooperate with the Library with respect to access to the property if they needed to do work in advance. I would request that we meet to discuss this new timeline. You should know that I am in the process of drafting a document for the City Council's consideration at their October 4, 2010 meeting for the eviction of the Urban League in the event that they do not vacate on time.
By majority vote of this body [Springfield City Council] and pursuant to authorization at MGL Chapter 79, Section 3, this City Council vote would be issued directing the Sheriff of Hampden County or his Deputy to make entry on the premises located at 765 State Street, Springfield, Massachusetts and to take possession thereof, on behalf of the City of Springfield’s Library Department, in the event that they are not moved out in time.
I will send an outlook invite for a meeting to discuss in more detail.
From Molly Fogarty, Director, Springfield City Library: We have just been notified that the Furniture and Shelving are scheduled to be delivered and installed the week of November 8th. After I meet with Ed Pikula and Pat Sullivan on Monday morning, we will determine a date for rescheduling the delivery and installation.
Please contact me if you have any questions.
Received Friday, Sept. 17, 2010, from John Ramsay, Asst. Dir., Springfield Library Dept: We have not received an update from the City Law Department about Mason Square progress. We will pass along any news once there is anything to report.

MSL Weekly Updates: Aug. 27 - Sept. 10
Friday, September 10, 2010
From Edward Pikula, Springfield City Law Dept: The city has not had a response to the last letter to the Urban League. [See Sept. 3 entry, copy of the letter below.] There is a question from [a former Library Commissioner] as to use and occupancy [fees]. The Urban League has not made any payments to date. The lack of communication has heightened my concerns. We need to go over the progress of the renovations and timeline. If we cannot get a confirmation of their move and if they cannot accommodate our plans, we may have to seek court intervention.
From John Ramsay, Assistant Library Director: We have attached a preliminary timeline from the architects, along with this note from Carol Leaders: Here is the timeline that has been prepared; note -- we still do not have a firm time for the roof replacement, but City Facilities is prepared to move forward. All other renovations hinge on the roof repairs and the Urban League vacating the building. [I've asked that this time-line be posted on the Springfield Library website.]

From Molly Fogarty, Director, Springfield Library Dept: I'm forwarding Attorney Ed Pikula's update to you. As Attorney Pikula states in the email below and in the attached letter, this latest issue may be based on a misunderstanding and not be a problem. As soon as we have a response from Mr. Thomas, we will forward it to you.
I'm also sending you a link to several new photos provided by Janet Stupak:

From Edward Pikula, Springfield City Law Dept: In speaking with Steve Mollica, I asked him for an update as to the Urban League's progress in moving. He spoke with the Urban League relocation expert and was unable to obtain an assurance that the Urban League would be out by the deadline promised. This may simply be miscommunication between the part of the Urban League relocation expert and Mr. Thomas, but in order to assure this stays on track, I have sent a letter to Mr. Thomas. I am attaching a copy for your information. [The letter from Atty. Pikula to Henry Thomas at the Urban League follows:]

Re: 765 State Street, Springfield, MA
Dear Mr. Thomas:
In your letter dated June 25, 2010 received June 29, 2010 you provided assurances that fact that the Urban League will vacate “no later than September 30, 2010” and you stated that you anticipated that “the actual date will be earlier than September 30, 2010.”
I received a report from the City’s relocation expert which is causing me to write to you to express my concern that the Urban League stay on track to meet the deadline of September 30, 2010. Based upon my conversation with Mr. Mollica, it appears that he has had some difficulty with respect to confirmation of the Urban League plans and efforts to move. Please confirm that the Urban League will vacate by September 30th. Considering the Library Plans for renovation and move-in schedule, it is very important that the Urban League meet the deadline.
Please contact me at your earliest convenience to confirm.
Very Truly Yours, Edward M. Pikula

From Edward Pikula, Springfield City Law Dept: Our relocation consultant indicates that UL has signed agreement for their new space and are on target to move out by the 9/30 date. I have not been able to meet with the SLF and SMA on the renovation bills as I have been tied up with the WMECO case and hope to have more info next week.
From Molly Fogarty, Director, Springfield Library Dept: Carol and I met with Steve Jablonski and he is working on a schedule which will include target dates for renovation projects, furniture , shelving , and equipment delivery and installation. As soon as that's available, I will send it out to you.

MSL Weekly Update
Friday, August 20, 2010
From Edward Pikula, Springfield City Law Dept: The City's relocation expert reports that in his communications with the Urban League they have indicated they are target for a 9/29 or 9/30 move. I need to meet with representatives of the SLF ( Springfield Library Foundation) and SMA ( Springfield Museums Association) to assure that funding is in place for our renovation related contracts, and hope to report more on that next week.
From Molly Fogarty, Director, Springfield Library Dept: Steve Jablonski is overseeing the roof replacement and will be meeting with Rivet Roofing . The Request for Proposals for Self Check and Media Management equipment has been submitted.
Friday, August 13, 2010
From Molly Fogarty, Director, Springfield Library Dept: The Law Dept. does not have any new information. The furniture and shelving have been ordered. I attended the Nike event last Sunday, and encouraged anyone that I spoke to, to view the “Coming soon“ display in our exterior display window. (It was a wonderful event!!)
In response to [the] request [to check the old Library sign], I have followed up with Henry Thomas, he has responded and let me know that he is checking into it. He thinks that the Springfield City Library sign was painted over, rather than covered. However, he is not sure and will update us as soon as he is. If the sign was painted, we can replace it with a new sign that reflects our current system signage.

MSL Weekly Update
Friday, August 06, 2010
Message from Ed Pikula: The Law Department has nothing new to report with respect to the Urban League. Our last understanding was that they were on target to relocate to temporary quarters as previously indicated.
In response to the question about the old Springfield Library sign on 765 State Street , Jean Canosa did some research and responded: I recently took a close look again at the signs on the Mason Square Branch Library. The photo on our website (http://www.springfieldlibrary.org/branches/ms.html) is old...those shrubs are long gone! As for signs, I believe the photo shows the former white and black sign that said Springfield City Library, located over … the portico. My inspection (from the ground!) leads me to believe that the library sign was either removed for replacement or essentially made unusable when the [Urban League] sign was affixed to it--I can't tell which method was used. I know the architect has this on the list of items to be addressed when the building is being prepared to return to a full-service library. (We are looking into this.) Still affixed to the brick wall, to the right of the entryway, is a scroll shaped sign noting Annie Curran's bequest. And not seen in the photo, but currently in place, is a library card-shaped sign, black letters on white background that reads Mason Square Branch Springfield City Library or similar wording. The sign is located on the same brick wall, above and to the right of the Curran scroll. I believe that sign was installed 3-5 years ago. That sign will be replaced with a new sign that we have ordered. We now have a display featuring the new Mason Square Library in the exterior Library display case, thanks to Janet Stupak.

MSL closed on Aug. 8 - update
July 30, 2010
Library Director’s Report: From Molly Fogarty: The Law Department does not have an update for this week. In response to Liz Stevens request to remove or cover the Urban League sign by next Sunday, we unfortunately cannot legally do that.
[As to the issue of signage, this is also a relocation issue. As with any other occupant, the City would not have a right to remove their business sign without consent or risk a claim of unlawful interference with their business. –per Ed Pikula, City Solicitor]
We have ordered a new sign for the Mason Square Branch, based on the other Branch sign specifications, which will be placed on the building once the Urban League has vacated. We have located a model of the obelisk sign that you may have seen at several of our branches and will have that sign modified and available for the 8th, to make the Library more visible. However, since it is a model, it is not constructed for outside use.
Unfortunately we will not be able to open the building on August 8th, as we had hoped to do. Nike is essentially shutting down the neighborhood and bringing in a great event, but no business or organization can open in the area or have an informational table etc. Jean Canosa learned this late last Friday.
I plan to be there, as well as some other staff, to participate in this wonderful event.
Please contact me if you have any questions.

MSL Weekly Update & Answers
July 23, 2010
Library Director’s Report, from Molly Fogarty: I am forwarding the weekly update from the Law Dept, which includes answers to Liz Stevens questions. (see below)
We will be ordering the shelving and furniture early next week, with an expected delivery date of early November. Steve Jablonski (architect) will prepare a current rendering of the new layout and a color board, which will be available in the current Mason Square Library in time for the August 8th event. We have made special arrangements to have the library open that day as well.
[Sunday, Aug. 8: Unveiling and dedication of the Basketball “First Game” Monument in front of the Mason Square Library building, and related activities opening 2010 Basketball Hall of Fame Enshrinement Week.]
Some Answers From Edward Pikula, Springfield City Solicitor To These Questions from Liz Stevens: Regarding the obligation to compensate for relocation - please clarify how many moves can be included, since they are talking about two moves.
When is the UL expected to begin paying use and occupancy fees?
What if the negotiations lasts until they have moved?
How does the payment of the use and occupancy get handled?
Does part of the cost of the moving van become their responsibility?
Do they write a check to the city? Do they write a check to the library foundation which will pay for the move?
I also want to address the issue of SIGNAGE. We should take the SUL sign off the building and put up the library sign. And it should be done before August 8th! On August 8th a big event will be taking place in front of the library building with the dedication of a memorial to the beginning of basketball. Huge day long event with basketball games on State St. on a temporary basketball court set up by NIKE, lots of food, unveiling of statuary, etc. The building will be in the background of a lot of pictures!!!!!!!! Please get the signage changed.
Dear Ed Pikula, I thank you for your patience and service to the city and the community. I also thank you, in advance, for answering my questions. Liz Stevens
Response from Attorney Pikula:
The UL is expected to begin paying use and occupancy fees retro to June 1.
If the negotiations lasts until they have moved, we will continue to pursue the matter thereafter.
Payment of the use and occupancy will be deposited in the City's general fund pursuant to Mass. General Laws.
The City will be responsible for reasonable relocation costs under the statutes and the regulations, including moving vans.
As to the issue of signage, this is also a relocation issue. As with any other occupant, the City would not have a right to remove their business sign without consent or risk a claim of unlawful interference with their business.

MSL 2-week update (July 9 & 15)
July 09, 2010
Law Dept. Report, from Robert Warren: The Urban League has informed the City that it will vacate no later than September 30, 2010, and perhaps earlier, to space in the Springfield Technical Community College Park. The Urban League has not identified a permanent location though it is exploring the possibility of space in the Indian Motocycle Building A. The Urban League and the City are still negotiating the use and occupancy payment. The City has also requested further information from the Urban League to determine that any proposed temporary move complies with the regulations. Answers to last week’s questions:
1) The "couple weeks" suggested by the UL as the time when they would announce where they were moving was over about two weeks ago. Is there a new date? (Answer) See above.
2) Has an amount been agreed to for monthly payments for use and occupancy? If so how much is it? If not, what steps will the city be taking to establish and collect it? (Answer) See above.
3) What additional steps will the city be taking to relocate the UL in time for refitting 765 State Street as a library in time for a November 1 reopening date? (Answer) The Law Department has been informed by the Library Director and Patrick Sullivan that the vacate date, of September 30, 2010, does not interfere with the proposed Library renovations.
July 15, 2010
Law Dept. Report, From Robert Warren: The Law Department is awaiting receipt of further information from the Urban League with regard to its "temporary and/or permanent" move plans as well as the use and occupancy payment. Please see below the responses to further questions:
1) The UL move-out date of September 30 leaves only one month until the projected November 1 re-opening of the branch library. Lee, can you describe how the library department will manage to work around UL operations and still complete repairs outlined by Scott Pierce in his December 2, 1009 report to the library commission ("...needed repairs and or improvements to the windows and doors, lighting, boilers, roof, garage and fencing, with total estimated Capital Expenses of approximately $163, 740.00.") and whatever other work will be needed to refit 765 State Street as a branch library? (Answer) As reported last week, Pat Sullivan and Lee Forgarty did not see a problem with completing the renovations and/or repairs. The Law Dept however, believes that a description of how this would be accomplished and any issues that the Urban League's occupancy raises should be answered by Pat Sullivan.
2) When does the city expect that negotiations over the use and occupancy payment will conclude? Will the amount of the use and occupancy payment and whether or not UL is making its payments be made public? (Answer) The City is hopeful that its negotiations can be completed within the next couple of weeks. The amount of the use and occupancy payment and the payment history will be made public.
3) Specifically what information is being sought from the UL relative to its temporary move complying with the regulations? (Answer) How long the UL expects to be in its temporary facility and generally reasons why such a move would not be suitable as a permanent location. It would also be helpful for the UL to be definitive about a permanent location and describe the timing that would be involved.

MSL 2-Weeks' Update
June 25, 2010
Library Director's Report : Roof repair cost estimates and planning with facilities are on target and [the Library Dept. does not] anticipate any extensive interior renovations.
From: Robert Warren, Springfield Law Dept.: As requested by Lee Fogarty (Library Director), I am providing this short update to you, relative to 765 State Street. Inasmuch as the City's relocation consultant is on vacation, for the week beginning June 21st, the Law Department does not have anything new to report.
Question from former Library Commissioner: In terms of the law department update, it appears that the [Urban League] has been able (or has not chosen) to follow through on announcing a decision on a new site by (approximately) today [June 25, 2010]. I'm wondering whether the city or the relocation consultant has asked the [Urban League] for a new and potentially more definite date by which they will have decided. Not to mention a date by which they will have vacated the site.
Answer from the City Law Dept: The Law Department believes that both dates are important. The Law Department will be in contact with the relocation consultant at the beginning of next week to request that he inquire about both dates.
July 2, 2010
The Law Department does not have any new information this week.
From Molly Fogarty, Director, Springfield City Library: The Mason Square garden looks great, we have new mulch, it has been weeded, new plantings and new benches. We will be meeting with [architect] Steve Jablonski next week to finalize furniture and shelving orders. Please contact me if you have any questions and have a great holiday weekend!!
Additional questions from former Library Commissioner:

MSL Weekly Update
From Lee Fogarty, Springfield Library Department: The Library is on schedule for planning for the reopening of Mason Square. We met yesterday with Steve Jablonski and have selected furniture and shelving for the Library. We will be finalizing details at our July 8th meeting, in preparation for submitting the order.
We did look at the garden area and are happy to see the benches have arrived.
City facilities will coordinate the following activities:
• Removal of the birch tree.
• Removal of the bird bath.
• Draft of a "master plan" for the garden, which would include a patio, performance area , plants that provide a learning experience and lend themselves to activities .
Since Northeast grounds only mows every two weeks, we are asking our maintenance staff to mow in between. Also, Scott had mentioned that we could get a delivery of mulch, so they will also mulch, weed and plant a few annuals. All of this should be completed by the first week of July.
It is important that the garden is presentable, attractive and usable for the summer reading club activities. When we have the Master Plan available for the public , they can look forward to the type of reading garden that the community deserves.
See below for the Law dept. update.
From Robert Warren, Springfield Law Department: The City responded this week, to the Urban League's request for a reduction in the amount of the established use and occupancy fee, indicating that acceptance of any reduction was subject to certain conditions, that allows both the City and the Urban League to move ahead with their respective plans. As of this update the City has not received a response. Also as of this date the Urban League has not informed the City or its relocation consultant, as to whether or not they have completed their negotiations and finalized their move plans.

MSL Answers to June 4th Questions
June 11, 2010, Answers to questions raised by June 4th update:
From Robert Warren, Springfield Law Department: The Urban League has informed the Mr. Mollica that it is still in negotiation with owners of potential sites. One of the sites is for lease and the other is available for purchase. A couple of the other sites that they were interested in fell through. The Urban League is hopeful that by the end of next week they will be able to make a decision.
1) If the Urban League moves to a temporary site and then to a permanent site, will the Springfield Library Foundation have to pay for TWO relocations? (Surely they are only entitled to one move at the expense of the SLF.)
Answer - The relocation regulations permit a temporary and permanent move.
2) What specifically are the "services that are being provided to the City/Library" by the Urban League?
Answer - General staff support for library patrons, reception, direction of people and computer assistance; liability insurance inclusive of library patrons; security for library services on the urban league side of the building; general maintenance (restrooms, vacuuming and cleaning); daily maintenance including grounds (litter, leaves, mowing, flower bed maintenance, windows, lighting, parking lot, trash collection and placement in dumpster, monitoring of operation systems; provision to keep the urban league side of the building open for two extra hours and provision for maintenance and security of computers owned by the urban league but provided for use to library patrons; monthly fee for security monitoring and response to police alarms for the building. Also noted was the space, utilities and maintenance for the last six years provided to the City, without charge.
3) How long will the city wait to receive the Urban League’s "notification of plans, etc." and a "formal request to remain" in 765 State Street before taking further action?
Answer - Presently indeterminable.
4) Since "a couple" generally means "two," we should know by next week's update where the Urban League will be moving, right?
Answer - In a perfect world yes.

MSL Update and a few questions
From Lee Fogarty, Springfield Library Department: We will be meeting with (Architect) Steve Jablonski in two weeks, to review preliminary furniture schemes and fabric samples, as well as a drawing of our interpretation of Annie Curran's House (the children’s reading room). We are also working with Kristin Brennan from "Gardening the Community" to plan a community flower garden for this summer. Neighborhood children will plant, maintain and sell the flowers at the local Farmer's Market.
Please contact me with any questions.
From Robert Warren, Springfield Law Department: The City is reviewing a request from the Urban League to reduce the use and occupancy fee established by the City, based on certain services that are being provided to the City/Library. As reported last week, the Urban League had informed our relocation consultant that the announcement of a replacement site was a couple of weeks away, pending conclusion of negotiations. The City is still waiting to receive the Urban League's notification of its plans for a temporary and/or permanent relocation site and its formal request to remain in occupancy at 756 State beyond its June 1st vacate date, pending finalization of its move and relocation claim.
Questions from former Library Commissioner McElwaine on this Update:
1) If the UL moves to a temporary site and then to a permanent site, will the Springfield Library Foundation have to pay for TWO relocations? (Surely they are only entitled to one move at the expense of the SLF.) [Springfield Library FOUNDATION is separate from the Library Department; the Foundation was established to manage money donated to the Library – particularly the Anne Curran Fund, which can be used only for the Mason Square branch library. – Note added by Kat Wright.]

Q&A on MSL Renovation Plans
After I sent out last week’s MSL Update, Anne Richmond had a few library ideas:
From Anne:
1. Include some fruit trees in the planting so we can have bowls of healthy fruit out for patrons! Or.... is there enough room for a community garden back there sometime in the future??? (I don't know the layout of the space.....
2. Organize the space/staffing to make the community room available to groups on the weekends and evenings even when the library is not open. Is there a low cost way we can make this happen??? Community meeting space is so needed!
3. Hire artist Sheila Coly (1000 cranes studio) to do a mosaic project as part of the garden redesign. She is an amazing artist and can do mosaics or murals with community youth... I think this is a wonderful opportunity for public art!! Sheila did the mosaic on Zanetti's wall (Armory St.) and she is amazing with kids. She's also worked at the Dunbar.
I sent Anne’s questions to Molly Fogarty at the Library and this was her response:
From Molly Fogarty: These are all great suggestions and are already included as concepts in our planning for the Mason Square Branch. We are working with Kristin Brennan from “Gardening the Community" to plan a community flower garden for this summer. This group employs neighborhood children. The children then sell the flowers at the Farmer's Market. At this point, we have funding for 18 hours per week.
At our other locations, groups can request to use the Community room for free when we are open. When we are closed, we can make the room available for groups, however, they need to pay for the additional security costs.
Community art projects are definitely being discussed. At this point, we are focused on getting the library open and are looking at the Spring for murals and other art projects. A mosaic mural sounds wonderful.
All of planning is based on community input and we will continue to update the community through our website, and at Commission meetings, and through the Mason Square Advisory Committee.
Any other suggestions for input??
This is a really exciting time for Springfield and for all of us as we bring the library back to the neighborhood.

MSL Weekly Update
SEE RENOVATION LAY-OUT PLAN FOR MSL at http://www.springfieldlibrary.org./branches/MS%20plan.pdf
From: Robert Warren, City Law Dept., Sent Friday, May 28, 2010: There was an article on the Urban League that was published in the Republican, on May 26, 2010. Additionally, the City's relocation consultant has been informed this week that closure of the negotiations with regard to a replacement site are still a couple of weeks away. The City is still waiting for the Urban League's formal request to remain in occupancy at 765 State Street pending finalization of its relocation claim and move plans, which may include a temporary move and a counter proposal with regard to the amount of the use and occupancy that will accrue after June, 1, 2010.
From: Carol Leaders, Springfield City Library: In addition, we met with Scott Pierce, City Facilities and Mike Tully, Parks Division to discuss plans to spruce up the garden behind the Mason Square Library. Mike is going to develop a Master Plan that can be implemented in stages. He has a few ideas that can be implemented right away (Phase 1) which include taking down a couple of dead trees; weeding; mulching; and planting replacement trees. Mike also found some concrete benches that we can use for Phase 1 of the project. We are also exploring the possibility 'A Gardening the Community' initiative involving neighborhood youth that would help beautify the garden. This will be great as the Summer Reading Program begins on June 21st.

MSL Weekly Update (Some real progress at last!)
From: Molly Fogarty, Director Springfield City Library: The Urban League has selected a new site!!!! See update from Attorney Warren below. Renovation plans are moving along. Steve Jablonski and staff have been working with the furniture vendor and a meeting is scheduled for next week to plan the Reading Garden. Please contact me if you have any questions.
From: Robert Warren, City Law Dept.; Sent: Friday, May 21, 2010; Weekly Update - 765 State Street: The City has been informed this week that the Urban League has found selected a new site and will make a public announcement once an agreement has been finalized with the landlord. The Urban League will be submitting a written request to the City to remain in their present space beyond June 1, 2010, until their move plans and their relocation claim can be finalized. The Urban League will pay a use and occupancy fee. The City will review the Urban League request once it is received.
Question - Relocation information provided below doesn't really provide represent any progress since we were also told last week that the Ul was negotiating on some unamed sites. Hearing more about the city's notice to quit and/or steps taken re collecting the use and occupancy fee would have been more informative.
Response - Information reported though succinct was accurate and in light of today's report, the negotiations were successful. A "notice to quit" is the first step in a summary process procedure. As discussed before this is an adversarial procedure that could be counter productive. Today's report reinforces the City's conduct of vacating the premises in a manner both professional and in accordance with Chapter 79A and its regulations. Collection of the use and occupancy fee is premature.
A use and occupancy fee by its nature is paid in arrears. Though assessed as of June 1, 2010, the use and occupancy fee is not due until July 1, 2010.

MSL Weekly Update
From: Robert Warren, City Law Dept., Sent Friday, May 14, 2010: Mr. Thomas has reported this week, to the City's relocation consultant, Steve Mollica, that the Urban League is currently in negotiations with a couple of sites, from the pool of sites that Urban League has been reviewing. On the City side, a meeting attended by the City Solicitor, Library Director, Facilities Director and staff was held, in early May, to review and discuss building repair costs (including a roof repair) for presentment to the Springfield Library Foundation, as well as the renovation plans, for the Mason Square Library building. At this meeting the Library Director, Lee Forgarty, also proposed, for this summer, the construction of a "Reading Garden" at the library site. Costs and plans for this endeavor are currently under development.
From: Carol Leaders, Springfield City Library: You can now view the overall floor plan design for the Mason Square Renovation Project on the Library's Website -- www.springfieldlibrary.org.
We will continue to keep you posted as the project progresses. Any suggestions on what you would like to see, please let us know.

MSL Weekly Update
From: Molly Fogarty, Director, Springfield City Library: Sent: Friday, May 07, 2010: As you can see below, there is no new information regarding the lease negotiation by the Urban League. Steve Jablonski attended the Library
Commission meeting (May 5) and presented preliminary drawings for the full service Mason Square Branch. Liz Stevens attended the Commission meeting. We met with a Representative from Tucker Library Interiors on Thursday at Mason Square to select furniture and shelving for the Library. Please contact me if you have any questions.
From: Robert Warren, City Law Dept.: The City's relocation consultant, Steve Mollica, has informed me that there have been no new developments this week.
From: Sheila McElwaine, former Library Commissioner: I understand from Tim Moriarty that Steve Mollica shared his sense that the UL was on the verge of announcing a new site at the Rebecca Johnson meeting. Can someone from the law department please elaborate for those who were not at that meeting? Might Steve Jablonski's drawings be posted on the MS library webpage?
From: Liz Stevens, Chair Mason Square Library Advisory Committee: Comments on two library meetings: (1) Steve Mollica indicated that some of the locations that the UL was considering were being kept confidential - even from Steve. (2) The drawings on the webpage is a great idea. It will help people begin to see this as a library. Piloting self checkout is one of the plans for the Mason Square Branch. There will also be a computer stocked room for Job Resources as well as many other computers available in the main area of the library. Read Write Now has decided to stay put so Mason Square will have a community room again for the first time in a long time. Steve J. has a plan for the children's room that will honor Annie Curran in a way that she did not plan but in a way that she deserves given how many times she has helped the neighborhood library.
From: Molly Fogarty, Director, Springfield City Library: Sent: Sunday, May 09, 2010: [Springfield City Library is] planning to set up a page on our Website, similar to the one that we had for the Forest Park Renovations. We will post the plans, updates, photos, details of the renovation, etc. This is a very exciting time and we plan to keep the community as well as our staff informed of the progress as we prepare to open a full service Mason Square Branch. Thanks to Liz Stevens for that excellent report.

Mason Square Library Status Report from: Edward Pikula - Fri 4/16/2010 9:47 AM
Here is the status report on the Mason Square relocation effort for the week of April 12th.
Mr. Mollica (the City's relocation specialist) had reported the following report for the week of April 12th:
Mr. Thomas, on behalf of the Urban League, is still in discussions with STCC. The Urban League however has concerns with the space that might be available. The first space, that has the most potential is on the technology side of the campus and is not available in incremental segments (the old Springboard tech space), and may be too big for their needs.
The second space is an historic house in need of restoration. The Urban League is evaluating and in discussion with STCC, as to whether it could use its capital endowment for the renovation and whether or not STCC would accept the renovation in lieu of rent. Further the historic site is on a more remote part of the campus and may be customer friendly to their constituents.
Bob Greeley showed them properties at 39 and 57 Mulberry Street. The house at 39 Mulberry was small. The larger building at 57 Mulberry would require the Urban League to have tenants. Both addresses are under consideration.
664 State Street is a viable possibility.
A meeting is being scheduled with Mass Development for possible space in the former Federal Building.
Discussions are still under way with Frank Colaccino, of Colvest, for relocating to the building next to the Burger King, on State Street. Rent and configuration are being discussed.
In addition, you should note that the Law Department has received a summary appraisal relative to use and occupancy ranges for 765 State Street. It will be forwarded to Attorney John Egan, Attorney for the Springfield Library Foundation, who has agreed to indemnify the City for its expenses/losses with regard to this taking/relocation and in exchange, who the City has agreed would act as trial counsel in any civil action. The purpose of the review prior to the determination of a use and occupancy charge, in consultation with the City's relocation consultant, is to make a proposal for the payment of use and occupancy to be presented to the Urban League, to be be effective June 1, 2010, in the event that they have not moved.
Additionally, with regard to the questions you forwarded: Questions re Relocation of UL from 765 State Street
1) Is the Springfield Library Foundation paying the relocation consultant hired by the city, Mr. Mollica? Is the Foundation satisfied with the pace of relocation efforts?
Answer) The relocation contract is with the City of Springfield. The City funds the contract from a gift made by the Springfield Library Foundation Inc.
2) How much has the relocation consultant Steve Mollica been paid to date? Does his contract specify a dollar amount for relocating the UL or is he being paid an hourly rate?
Answer) The W.D. Schock Company has been paid, to date $7,700.07. The contract has an hourly rate, but is capped at a total of $10,000.
How was the relocation effort described to Mr. Mollica? Was he told that freeing up 765 State was a high priority and told to expedite the process in a lawful but timely manner while also taking care not to provoke a lawsuit? Was he told to cut the UL as much slack as possible? Was he told there was no particular urgency to relocating the UL? Or was he told something else?
Answer) W.D. Schock, Company, Inc.'s proposal and contract are to be performed, in accordance with State Statute and Regulations.
3) Besides initiating “discussion of a use and occupancy agreement and/or use and occupancy charge,” what other measures are available to the the city if on June 1 the UL is still in the building ?
Answer) Summary Process (which is heavily frowned upon in the regulations) is an option. It is the Law Department's opinion that this option by involving the court system may significantly delay the relocation process, through the introduction of the judicial process.
4) Mr. Pikula has alluded to the need to avoid disrupting on-going UL programs by an untimely relocation. Is the city aware of a date by which time current UL programs will have wound down and relocation would be least disruptive?
Answer) It is the understanding of the City and our relocation consultant, that the Urban League's programs are ongoing and that to minimize the disruption, weekend moves may be considered.
5) The city council voted to take 765 State Street on August 24, 2009. An email from Ed Pikula says the deed was to be filed at the registry on September 23. I think that is the date on which the four month period for relocating the UL began. That brings us up to January 23, 1010. On February 3, Attorney Bob Warren told the library commission that only one meeting (on December 3) was held with the Urban League between September 23, 2009 and February 3, 2010. In fact, this appears to have been the only fact-to-face meeting between the relocation specialist Mr. Mollica and the UL.
Answer) The relocation consultant, has been in communication with Mr. Thomas, and/or his consultant and staff at least on a weekly basis and is satisfied that the Urban League is aware of the deadline to vacate and is working to secure a suitable replacement location.
6) Why, when and how did the date for the UL to vacate change from May 1 (Lee Fogarty’s date in January) to the end of May (cited in Bob Warren’s update of April 9)?
Answer) Per a requisite regulatory notice May 8, 2010 is the Urban League's vacate date. In view of the complexities involved in any relocation and the fact that possible replacement relocations may become available at the end of the month, it seemed logical to make the end of May the vacate date. Pursuant to the regulations a vacate notice is being prepared.
Please distribute this report to all interested parties.

Mr. Thomas has reported to the City's relocation consultant, Steve Mollica, that he waiting for a couple of the principals of the replacment locations that he is interested in to get back, to the Urban League, with pricing points. He also reported that he was contacted by Bob Greeley, a commercial realator, who had two locations that might fulfill the Urban League's needs. MSL Update
Weekly Update from Attorney Robert Warren (City Law Dept.):
The City's relocation consultant, Steve Mollica received an after hours call, at the beginning of the week, from Henry Thomas (CEO, Springfield Urban League), indicating that he was traveling but would be in contact. Henry Thomas did call Steve Molica at the end of the week to provide him with a brief update.
That update was that the Urban League was in conversation with Springfield Technical Community College and the owners of property at 644 State Street and 503 State St. , as well as one other undisclosed location. Henry Thomas indicated that the Urban League plans to come up with a short list of three properties, for an internal committee to review and make recommendations.
The Planning and Economic Development Department has also provided the name of a local real estate agent, Robert Greeley, to Steve Mollica. Robert Greeley indicated that he believes he has a couple of suitable sites for the Urban League. Steve Mollica will be discussing those sites with Robert Greeley next week.
Meanwhile, I have been meeting with Steve Jablonski, and we are still targeting November, 2010 for the opening of the full-service Mason Square Branch, that still requires that the Urban League vacate the building by the end of May .
Please contact me , if you have any questions.

MSL Weekly Update
Robert Warren (City Law Dept.)sent the following update:
The following is the weekly update of the Law Department on the status of 765 State St.
The City's relocation consultant, Mr. Mollica, is waiting for a return call from Mr. Thomas today to review the status of any potential and/or new replacement sites. As you will recall, Mr. Thomas and Mr. Mollica had agreed to talk today. Mr. Mollica did pass along 443 State Street, the former Kavanaugh Furniture Store to Mr. Thomas, at the beginning of the week. Mr. Thomas replied that he is aware of the site and had previously been inside the building. Mr. Thomas felt that the building was much too large for the Urban League's needs. Mr. Molica will be contacting the City's Planning and Economic Development office to see if they have any more suggestions.
I have been in contact with Steve Jablonski., he has submitted his proposal for architectural services to Pat Sullivan and the contract is in process. We have asked to have a Notice to Proceed, from City Purchasing, to begin work as soon as possible.
Please let me know, if you have any questions.

MSL Weekly Update
Robert Warren (City Law Dept.) sent the following update:
Mr. Thomas also reported that he was actively pursuing three other potential sites, two of which were confidential. The other site was the former KFC Administrative Building at 644 State Street. He noted that the site was currently being used as temporary space by the MLK Jr. Charter School which would be in the building through the end of the current school year.
Mr. Mollica stated that the Urban League was conscious of the time constraints and were doing their due diligence with regard to replacement sites. Mr. Mollica and Mr. Thomas have agreed to talk again next week with regard to the status of any potential or new sites.

I am again providing this update on behalf of Ed Pikula. Steven Mollica spoke this week with Henry Thomas regarding potential relocation sites. With regard to the sites provided to the Urban League through the City's Office of Planning and Economic Development, as well as additional sites identified by the Urban League, the Urban League has made the following assessments and comments:
- Holy Family Church 235 Eastern Ave-poor location and conversion issues.
- Mosque 727 State St.--too big and potential costly building improvement issues.
- Dickinson Funeral Home--305 State St.--did not check out , but not preferable area.
- Verizon Building- 365 State St.--too big and limited parking.
- 503 State Street ( next to Burger King)-potential, but too large by itself-space potential is good.
- Former Open Pantry-287 State St.--access to clientele issues.
- Masonic Temple-very concerned with cost to maintain and carry.
- Mason Sq. Firestation-issues with location-accessibility and parking.
- MCDI property-140 Wilbraham-concerned that timing would not work-MCDI not ready to leave.
- Property owned by AIC on Mulberry Street as possible build, but AIC wants lot for parking.
- Former Hampden Dodge by Mass Mutual, too big as is and possible retrofit and contamination issues.

MSL Weekly Update
The City Council Finance Committee (at their meeting on Wednesday , February 17) requested an update on the relocation of the Urban League and questioned why the Urban League is still in the building after four months, . Attorney Pikula reported that the city is following the Mass General Laws as they apply to Eminent Domain. The Relocation Specialist is aware of the occupancy requirements for the Library Department. The City Council wants to move this process along, and has requested a timeline from March-May. The City Council has requested that a report be submitted by the Law Department before the next meeting and that the report be sent to the media to keep the community informed. Several residents, including Ruth Loving and Mo Jones, expressed their extreme frustration with the process.
Thanks to Commissioner O'Connor, Liz Stevens and Kat Wright for attending and speaking at the meeting.
In case you missed it, there is an article in the Local Section of Today's Republican by Peter Goonan. [Friday, Feb. 19, 2010]
